LEGAL CONTRACT

By placing an order, you are forming a legally binding contract with NixLAN Designs, for products and services, and you agree to be bound by the following Terms and Conditions.

CUSTOMERS

If you are placing this order in the name of a company, you must be legally authorized to place this order for the company.

PRICING & QUOTATIONS

Prices published at the NixLAN Designs website are subject to change without notice. Every effort will be made to notify clients of price increases or discounts in advance.

Quotations, either emailed or faxed, will be honored for up to 30 days after the quote date.

Published prices at the NixLAN Designs website are based on clients supplying digital files prepared according to written standard guides at the NixLAN Designs website. Failure to setup files according to these guidelines may result in hold on order or additional charges .
Changes made by NixLAN Designs to client supplied files will be subject to extra charges.

TERMS OF SALE

NixLAN Designs accepts cash, personal and company checks & money orders.

All orders require to be PAID in FULL upon placing an ORDER.

In the event that a personal or company check is returned for non-sufficient funds, the Client will be required to pay a $25.00 NSF fee to NixLAN Designs.

In the event of non-payments that lead to dispute and/or litigation, the Client agrees to pay all legal and collection fees incurred by NixLAN Designs.

SALES TAX

All California State Client are obligated to California Sales Tax (8.75%). US clients from other states are not obligated to pay taxes.

PROOFING, COLOR MATCHING & PRINT QUALITY

Designed or altered by NixLAN Designs art is subject to proofing procedure as follows. 1st proof is subject to total reject to unsatisfactory of the customer's idea of design or pre-approval of design with minor changes to information, layout or design. 2nd proof is to be prooved throughly for all information spelling and grammar. All information to appear on the job is to be supplied before 2nd proof. 3rd proof (if necessary) is an approval of artwork and must be approved to escape additional charges. Any changes on design, information or layout after 3rd proof are subject to an extra charge.(exceptions may apply if 1st proof was unsatisfied). If more than 5 proofs requested the design price will cordinally increase, grow or even double. Although additional proofs may be deducted in case NixLAN Designs associate or designer mistakes. No errors or omissions may be fixed after final approval. See Errors and Ommisions below.

All Press Printed Full Color Jobs ordered through the NixLAN Designs website are "gang printed" meaning that several different orders are ran on one large run. NixLAN Designs will reproduce color from digital files as closely as possible, but may not exactly match color and density due to limitations in the proofing and printing process, as well as neighboring image ink requirements. A reasonable variation in colour between original materials, proofs and the completed order, will be considered acceptable print quality.

Clients must provide high resolution images suited to the offset printing process. NixLAN Designs is not liable for images printing poorly due to the Client providing low resolution images.

Clients must provide all full color printing images in CMYK format. NixLAN Designs is not responsible for any color shift that occurs in conversions from RGB to CMYK colour modes.

Full colour jobs that contain large solid areas of black ink should have the black set up as Rich Black (see standard guides section of website). NixLAN Designs will not be responsible for printing a consistent, solid and rich black if the Client has not set up their files accordingly.

 

BUSINESS CARDS PRINT & PAPER GUIDES:

All business cards are printed only after customer's upproval! See Proofing & Color Matching.

16pt UV Coated Busienss Cards

16pt UV BCs are gang printed on large sheets of paper with other orders and are not to be cancelled or eddited after customer's approval. The cards are UV Coated on Front & Matt on Back. UV Coating May be applied to both sides at no charge to customer upon request. 100% Re-Order Price will be charged for additional order or customer's mistake in proofing process. Standard turnaround time is 5-7 business days. No rush delivery fees may be applied.

12pt Coated Busienss Cards

12pt Coated Business Cards are printed individually on sheets with Coated Front & Matt Back and are covered by NixLAN Designs' 50% satisfaction guarantee. (All previously printed cards must be returned to NixLAN Designs. Shipping & handling, rush fee or delivery charges are not refundable.) Rush delivery fee of $25 may be applied on orders over $100. (Rush turn around time is 1-2 business days. No guarantee.)

10pt Matt Business Cards

10pt Matt Business Cards are printed individually on sheets with Matt Front & Back and are covered by NixLAN Designs' 50% satisfaction guarantee. (All previously printed cards must be returned to NixLAN Designs. Shipping & handling, rush fee or delivery charges are not refundable.) Rush delivery fee of $25 may be applied on orders over $100. (Rush turn around time is 1-2 business days. No guarantee.)

THE MANIFEST

Each customer must read and agree with THE MANIFEST posted on the web site. Nixlan designs reserves the right to refuse service to anyone.

COMPLAINTS

All complaints must be made within 5 business days of receipt of the job. Orders with manufacturing errors and/or defects will be rerun on the next print run at no charge to the client, at the discretion of NixLAN Designs. NixLAN Designs' sole liability shall be limited to reprinting of the order. Unsatisfactory orders as a result of Client errors will be reprinted at a reduced rate of up to 50% OFF.

ERRORS AND OMISSIONS

NixLAN Designs is not responsible for errors and omissions APPROVED by the Client. The client is solely responsible for errors missed during the proofing process of either artwork supplied by the client or artwork created by NixLAN Designs.

INDEMNIFICATION

The client will indemnify and hold harmless NixLAN Designs from any loss, expense, and damages arising out of violation of copyright or trademark laws from the illegal use of images, photographs, slogans, trademarks, or graphical work supplied by the Client.

DELIVERY & SHIPPING

All posted turnaround times are approximate and although NixLAN Designs will make every effort to meet these delivery times, NixLAN Designs will not be liable for any costs or damages resulting from deliveries made later than expected to the Client.

Delays or damage during shipping are the sole responsibility of the carrier providing shipping services. NixLAN Designs is not responsible for delays or damage caused during shipping.
